Activision Proceeds With Jury Trial In Suit Against EA

Motions Filed for Summary Judgment by Electronic Arts, Former Employees West and Zampella Denied SANTA MONICA, Calif. - Activision Publishing, Inc., a wholly owned subsidiary of Activision Blizzard, Inc. (Nasdaq: ATVI), announced that the Los Angeles Superior Court has denied a motion brought by Electronic Arts, Inc. (EA) for summary judgment, thereby permitting Activision to proceed to trial on its $400 million contract-interference suit against EA.. At a hearing held yesterday, December 21, 2012, Judge Elihu Berle denied EA's motion, finding that the evidence presented by Activision supplied a basis for a jury to potentially conclude both that EA had intentionally interfered with Activision's employment agreements with former Call of Duty game developers, Jason West and Vince Zampella, and that EA had aided and abetted West and Zampella's breach of fiduciary duties to Activision. A related summary judgment motion put forth by West and Zampella was also denied. In the suit Activision alleges that West and Zampella breached their contracts and duty of loyalty to Activision by conduct that was insubordinate and otherwise improper and that West and Zampella's misconduct was caused, at least in part, by EA's unlawful tampering. A jury trial in the case is scheduled to begin on May 7, 2012.

NeverDead limb-ers up for February release

Konami Digital Entertainment GmbH will release its demonic action title NeverDead for PlayStation®3 and ® on February 3^rd, 2012, the publisher has confirmed. The brainchild of Shinta Nojiri, and co-developed with Rebellion Software, NeverDead stars an immortal hero called Bryce Boltzmann who, alongside his partner Arcadia, works for an agency tasked with dealing with demonic incursions. As demons from the dawn of time emerge on present-day Earth, so Bryce – armed with an arsenal of guns and a Butterfly-Blade – and the gun-toting Arcadia must locate and destroy the hostile invaders. As the malformed adversaries appear, the heavily-armed Bryce must protect his sidekick and work together to kill them all. However, as the monsters get larger and more vicious, the side-effect of Bryce's immortality is revealed. For, as the player is attacked by the various miscreants, Bryce can be torn limb from limb, but can simply reattach the parts to his body. Even when all limbs have been removed, Bryce can roll around as a head, looking to reattach his lost parts. He can even use his amputated body parts as weapons, throwing arms into clusters of monsters, and still firing the attached gun, or lobbing his head into seemingly impossible areas, to gain access to new parts of the map. "For NeverDead, we've gone all out to change the approach the player takes in battle," explained Shinta Nojiri, creator of NeverDead for Konami Digital Entertainment. "Losing a limb is a mere inconvenience and Bryce's physical skills allow a wealth of ways to take out the enemy – from close-range combat, to throwing limbs into clusters of monsters and shooting them remotely! The Pandas – Masters of Martial Arts For years they train in the secluded monasteries of their homeland, tempering body and spirit with the aspiration of becoming a monk. Using this life force, they instil fear in their foes, both in close combat as well as long-range fighting. Like the other races, pandas are given the choice between two skill specialisations once they reach level 15. One such specialisation is that of the Fire Breather. But the combination did not work out well for eBay and the experiment failed. eBay had tried promoting the conversation of buyers and sellers on the auction site, which didn't succeed. They later sold Skype to a group of technology investors. With a failed experiment in its budding years, Skype was still successful in attaining a large user base. The reason for the popularity of Skype and increasing profits was its ability to connect people throughout the world. Skype has become one of the largest mediums all over the world to communicate, not just for personal use, but for professional use as well. Microsoft will not disconnect Skype from its other clients; in fact their chairman informed that they plan to support Skype in its other deals. They also plan to invest in projects of Skype which are not Microsoft- related. Skype users will be connected to Xbox live, Lync, Outlook and other communities through Microsoft. Microsoft also plans to introduce Skype in its Windows Phone Devices. The division of Skype, which will now be a part of Microsoft, is going to be headed by the CEO of Skype. Mobile phones drive digital traffic around the world, while tablets are gaining steam. The share of non-computer traffic for the U.S. stood at 6.8 percent in August 2011, with approximately two-thirds of that traffic coming from mobile phones, and tablets accounting for much of the remainder.
Increased WiFi availability and mobile broadband adoption in the U.S. are helping drive connectivity. In August 2011, more than one third (37.2 percent) of U.S. digital traffic coming from mobile phones occurred via a WiFi connection. This percentage grew nearly 3 points in just the past three months. On the other hand, tablets, which traditionally required a WiFi connection to access the Internet, are increasingly driving traffic using mobile broadband access. In August, nearly 10 percent of traffic from tablets occurred via a mobile network connection.
Today, half of the total U.S. mobile population uses mobile media. The mobile media user population (those who browse the mobile web, access applications, or download content) grew 19 percent in the past year to more than 116 million people at the end of August 2011.
iPads dominate among tablets in driving digital traffic. In August 2011, iPads delivered 97.2 percent of all tablet traffic in the U.S. iPads have also begun to account for a higher share of Internet traffic than iPhones (46.8 percent vs. 42.6 percent of all iOS device traffic).
In the U.S., tablet users display the characteristics of early technology adopters: young males in upper income brackets. In August, 54.7 percent of all tablet owners were male and nearly 30 percent were age 25-34. Nearly half (45.9 percent) of tablet owners belonged to households earning $100K and more.
Nearly half of tablet owners made or completed a purchase on their tablet. Tablet owners exhibited significant use of their devices throughout the entire online shopping process – from doing the initial planning, conducting product and store research, making price comparisons, to finally transacting. In the past month, more than half of tablet owners looked up product or price information for a specific store (56 percent) and read customer ratings and reviews while on a tablet (54 percent).
Nearly 3 out of 5 tablet owners consume news on their tablets. 58 percent of tablet owners consumed world, national or local news on their devices, with 1 in 4 consuming this content on a near-daily basis on their tablets.
Tablets facilitate real-time social networking. Nearly 3 in 5 tablet owners updated their social networking status or commented on others' status on their device during September, while slightly less than half shared their location using a location-sharing site during.
The incremental reach through mobile and connected devices should not be underestimated. In the case of a publisher such as Pandora, the incremental reach of additional channels, such as connected devices, is significant. In August 2011, the additional mobile and connected device audience for Pandora accounted for more than half of their total cross-platform audience.

iOS is Leading Connected Device Platform by Device Share and Traffic Share Although the Android platform accounts for the highest share of the smartphone market (43.7 percent in August), its total audience among mobile and connected devices in current use is eclipsed by the Apple iOS audience. The iOS platform had the highest share of connected devices and smartphones in use at 43.1 percent, fueled by the iPad's dominance in the tablet market, while Android accounted for 34.1 percent of the total mobile and connected device universe.

Now I know you have heard of Kingston Technology. If you have not you probably have been living under a rock. Looking at the numbers they must be doing something right to have that type of revenue. According to the press release "the $2.4 billion increase in sales over 2009 was attributed primarily to a rise in average selling price (ASP) and increased shipment volume."

Increasing the cost of the product would be one of the major factors, especial if the demand is present. Great Product + Great Marketing = Demanding Customers = Company Meeting the Demand = Satisfied Customers = Increased Sales = Small Justified Price Increase = Increased Revenue.

It's a numbers game people and timing is everything!

Will Sprint buy T-Mobile USA?

It's been the buzz in the tech world and it's all over the news. Will Sprint buy out T-mobile USA? I sure hope not! For the longest Sprint and Deutsche Telekom (T-Mobile) have been in talks so it's hard to say if it will happen. Today Sprint's stocks have risen 5% at the news of the buy out.

Let's face it, both companies have problems. T-Mobile has a marketing problem and not so great a selection of phones. I must say that I am loyal customer of T-Mobile. Some people are calling this a win situation. I'm calling it a fail situation. Two struggling companies coming together equals one big struggling company with plenty of resources to fail.

Why am I saying that the merger will fail? Let's look at the track record. T-Mobile's 4th quarter sales where down. The Phones T-Mobile offers suck. They both have problems attracting new customer and combining the two current marketing departments would fail. They need new blood that understands the market. Not only understands the market but listens to the customers. Sprint fails and T-Mobile struggles with this.

3 years ago I had Sprint and I left them for T-Mobile. I hate Sprint with a passion. Here is a list of why I hate Sprint:

Customer Service Sucks!
Pricing/Data Plan Sucks!
Phone Selection Sucks!
Company as a Whole Sucks!

What can T-Mobile USA do to attract new customers? How can they improve their marketing? I don't have the answers.

Ok, so if they merge what will the name be? Will they continue to call the company Sprint? or will they change the name. Let's have some fun with this... Trint Mobile? SpriT Mobile? Tnt Mobile? Or how about a new name... SpurT Mobile?

One thing I do know is that if Sprint buys out T-Mobile USA I will be taking my family plan and my 4 phones over to Verizon!

So I decided to have a little fun with the post and just do random stores off the top on my head. So I figured that I would re-post these very short stores lol (don't mind the spelling, they where very quick posts):

Story 1:
John sat on the beheaded corpse of an enemy and looking out over the battlefield. It was a long hard fight but his team finally won. John took a deep breath, inhaling the stench of decay and blood. He found it quite interesting that this alien species took sport in watching two different races fight to the death. He wondered to himself... is this what I was made for? Is this the type of life I'm meant to live? He heard one of his comrades come up behind him "Hey John, that was one nasty fight. I thought we were all going to die till you did what you did." Till I did what I did rang in his mind...

Story 2:
"With each dieing breath I breath I will fight till the essence of my being fades away into the black and my lifeless body drops at your feet." John was always a poet when it came to dark dismal epilogue. Even in the face of death he was overly dramatic. The creature squatted in a dark corner of the room looking at John through beady red veined eyes. John tried to see past the darkness but the creature positioned itself in such a way to take advantage of the shadows. All John could see was blood shot eyes looking at him. No other sound came from the corner but John knew this creature well. He had fought against their kind. He could picture the hunched back, elongated arms and short powerful legs. John had just stepped out of the shower, he had a towel wrapped around himself. His children could be heard playing in the den. He stood frozen in place the creature was wateing for him. "So what do you want?" John asked "Do you have a message for me or have you been sent to kill me?"......

Story 3:
"give me the game pad!" Jon screamed at his younger sibling, his face turning red with rage. "you've been on the xbox for over 3 hours!" He stood up with his hand on his hips trying to display an air of authority but rather looking like an out of control child.

"What do you mean I've been on for over 3 hours?" his younger brother retorted not taking his eyes off Black Ops. "3 hours is nothing compared to when you were on for 29 hours straight and pissin in that jar you have hidden under your bed."

Jon's anger swelled at that comment and he lost all control. "If I can't play neither can you!" he quickly grabbed the xbox and threw it at the 52 inch screen. "Awwww crap!" Jon screamed, before he could gain control of his anger the xbox slipped from his fingers, like slow motion he watched it go through the screen.

Jon's younger brother sat with wide eyes, in shock from what he just witnessed. "Dad's going to kill you when he get's home from working his part time job."

Jon knew what that TV meant to his father. He worked a part time job cleaning port-o-potties for the homeless just to pay for that TV. Jon ran upstairs and started packing his bags.

Jon's younger brother followed him upstairs. "where are you going?"

"Away from here!" Jon heard the confusion in his brothers voice. "I have 3 hours before he get's home, I'll be long gone by then."

Post 4:
Jon and Kim left the restaurant, they had only 10 min. before the bus showed up.

"It was cold outside." Kim said. It was cold outside, the temperature was -10 degrees. "I wish this bus would hurry up and get here!" Kim complained about everything, the food they ate, the waiter, the people in the restaurant and now the cold.

"Look" Jon said with a sly look in his eye, he was tired of hearing her complain "The food was good, the waiter did his best... I know it's cold out here but your going to have to suck it up. I can't help it our car is down and you did not want to cook so we had to go out to eat."

"Just shut up." Kim replied "You know it's that time of the month and I don't feel like hearing your mouth! When I get home I'm calling my mom to come pick me up, I can't live with you anymore."

Thank God! Jon Thought to himself. I'm happy to see her go! She was a leach anyway. Jon decided to have some fun with her. "Look I'm sorry" He was lying, he was not sorry. "I know it's cold. Why don't you stand behind me, the food gave me bad gas..." He was enjoying this "The smell may be real bad but the heat will warm you up."

Kim lost it. Jon took a hard right across his face. "You sick excuse for a human being!" Blood trickled form Jon's lip. She knocked a tooth loose and his head was spinning. Kim stomped off headed back to the restaurant. It was worth the pain to see her go.

AT&T Galaxy Tab Overclocked

On XDA Bauxite has successfully overclocked the Galaxy Tab to 1.2ghz. I'm sure the device is capable of exceeding that. I hope this opens the door for the Tmo version to be overclocked.

TMOUS GALAXY Tab no phone but ringtones

Have you noticed that although you do not have a usable phone on the TMOUS GALAXY tab they left all the ringtones? Is this an indication that they may release the phone capabilities in the future or was this just a sloppy rush to get the tab to market for the holidays. I wonder if the other careers in the U.S. did the same thing.

Galaxy Tab bluetooth issue with WEP410

You can not pair the Samsung WEP410 blue tooth device with the Samsung Galaxy Tab. I find it funny and ironic that they both are Samsung devices and unable to communicate with one another... that's like an older man and a younger man talking and not understanding one another... at all.

So I put together a 6 step guild on how to do this:

These are instructions for T-mobile USA 1024MB

Step 1
Download the following:

HSPL 3 from here
Task 29 from here
Find a ROM you like from here and download it.
if your going to run Android find a ROM that works well with Android. I use Elegance ROM that can be found here
Find an Android ROM you like from here or here and download it.

Step 2
Flash your phone using HSPL 3 watch this video:

Step 3
Run Task 29... watch this video:

Step 4
Install the ROM you have selected following the Dev's instructions

Step 5
If you are going to install android onto your Micro SD Card I suggest you do the following: Copy all the files from your Micro SD card onto your computer then format your Micro SD card. After formatting move the files back onto the SD card.

Step 6
Follow the instructions on how to place the Android build you downloaded onto your SD card.

Samsung Galaxy Tab - T-Mobile

Well the questions were out on who will be the first carrier to get the Samsung Galaxy Tab and it looks like T-mobile will be the first carrier in the US to release this awesome peace of machinery. T-mobile said they will be ready for sales some time in November for the holidays. Eat your hart out you other carieres.

With a 16 or 32g option to include an expansion slot that you can fit another 32g into... wow 64g to work with is pretty nice... I lost my train of thought... I just can't wate to get my hands on this one.

Samsung NC10 - How to Boot from Thumb Drive

I searched the web, YouTube, and forums to find out how to boot this Samsung NC10 netbook from USB. Each and every one said hit F2 and enter bios to change boot order. well I hit F2 to check if it recognized my 4 gig thumb drive... it did not. So I tried a different 4gig thumb drive it did not. Then I tried a Micro SD Reader, it did not work. After entering bios each time it did not show up on the boot list. I figured there had to be a way to boot from the USB device. After hours of playing around with the computer I started hitting the F command keys while the machine was booting. I found out that the key to hit is F9.

That's right to boot your computer using your thumb drive hit F9.

Do you want to know why I wanted to boot from you thumb drive? Well I wanted to get rid of the Win XP operating system and Give Lenux Ubuntu a try and see how that works.

Build a Gaming Computer for less than $600?!

I've been looking at posts saying you can build a gaming computer for $600.00 so I had to put that to the test. Now I did supply some items for the build and bought the other items from Micro Center.

Here is what I had on hand for the build:

1) Power Supply (eXtreme Power Plus 500 Watt ATX 12V Power Supply) $55.00
2) Graphics Card (Radeon HD 5750 1024MB DDR5 PCIe 2.0 x16 Graphics Card) $125.00
3) Hard Drive (200gig, 7200rpm) $25.00 (yeah you can find it for that price if not cheaper)

Here is what I ended up buying:

1) Mother Board (Asus M4A89GTD PRO/USB3) $160.00
2) Processor (Phenom II X2 555 Black Edition) $99.00
3) Case (AZZA Spartan 101 Mid Tower ATX Case) $50.00 (after mail in rebate)
4) Ram (Kingston 4GB (2 x 2GB) DDR3-1600 $100.00 (after mail in rebate)

Total build = $614.00
Ok, I went $14.00 over my budget. If I would have orderd the parts from off the web I'm sure it would have been under budget but I wanted to get the build out of the way and decided to buy from the retail store.

This mother board is made for overclocking! Not only over clocking, with this motherboard you can easily unlock 2 cores on the Processor which now makes it a 4 core processor. When unlocked it is equal to (or comes close to) the Phenom II X4 965 Black Edition. Now you can't beat that for the price! You can over clock this processor, you CAN over clock this processor (I had to say it twice)! Just google it and you'll see what I'm talking about!

the case is nice and comes with 3 fans. It has plenty of room on the inside, so much room that I had to get an extension so that the top headphone wire could be connected to the mobo.

On this build I run Win 7 Ultimate with dual monitors. I experience no lag on high settings when playing World of Warcraft, Allods Online, Crysis, Halo, and other games. Multitasking is a breeze. Boot up is quick.

Later I am going to add another Video card for CrossFire and 4 more gigs of ram. And that should complete the build.

For anyone looking to build there own gaming computer, I would with out a doubt recommend this build!

I'm a WoW addict...again

I took a break from WoW and now I'm back playing it... again. I tried Aion, Warhammer, Allods and a few others not worth mentioning (lol) but I ended up coming back to WoW, no other game plays like it or offers the ability to customize the way your screen looks.

I no longer played Horde, ditched my Hunter which I've been playing since the game was released. I'm Alliance... yeah... an Alliance Night Elf SP.

I do recommend the following trade skills: Skinning and Mining! A great way to make gold.

Allods - Finally A Spam Filter

The patch was last night and they have added a spam filter. Although I like the game I actually stopped playing because of the massive amount of spam. I hope this works in killing the spam (Spam must die!). I'll have to log in and check it out.
